Pita Jungle Franchising Corp. and its relates, affiliated, or subsidiary companies (collectively, “Company,” “we,” “us,” or “our”) are committed to protecting the privacy of certain data that is collected from you and that you submit when you access this website or websites and applications under our operation and control (collectively, the “Site”). We recognize the sensitive nature of much of the information with which we are entrusted on a daily basis, and we are committed to the high standards of privacy and security. The nature of our business requires at times we gather information that is of a personal nature and you wish to keep protected. This Privacy Policy (“Policy”) is intended to familiarize you with our policies for the gathering, use, maintenance and protection of personal information on the Site. 

More specifically, this Policy summarizes how Company handles the personal and other information users of the Site provide while accessing and using the Site. Please review this Policy carefully. Company reserves the right to change its Policy at any time, in which event the Site will contain a notice of the change. Changes will be effective immediately upon posting to the Site. By accessing the Site, you are indicating your agreement to Company’s Policy. If you have any questions or concerns about the Policy, please contact us using the information provided below. 

Information Collected. When you access or use our Site, we may collect personal information from you. Examples of that personal information includes, but is not limited to, the following categories:

  • Identifiers – such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, or other similar identifiers.
  • Characteristics of protected classifications under California or federal law – such as race, religion, and age.
  • Commercial information – such as products and services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies, as well as information provided when making a purchase including payment card information. This also may include information about the restaurants you want to visit, or the orders for food you place with us, food preferences, etc. It also may include information you provide about our business, employees, franchisees, or similar information when you agree to voluntarily participate in a survey.
  • Internet or other electronic network activity – such as browsing history, search history, a consumer’s interaction with an internet website, application, or advertisement, as well as activity on Wi-Fi.
  • Geolocation data – such as location information while using our Site.
  • Professional or employment-related information – such as if you seek employment with us which might include your work history and salary information.

We also may compile statistical information concerning the usage of the Site. This information allows Company to monitor its utilization and continuously improve its quality. Examples of this information would include, but not be limited to, the number of visitors to the Site, or to sections or pages within the Site, patterns of traffic flowing through the Site, length of time spent on the Site, or in sections or pages of the Site, the other sites that refer visitors to the Site, the pages of the Site that visitors frequently use as entry and exit points, utilization of the browser and operating systems and versions used by visitors to the Site. 

In order to compile this information, Company may collect and store your IP address, your operating system version, your browser version, the pages you visit within the Site, the length of time you spend on pages within the Site, the site from which you linked to ours, search terms you used in search engines which resulted in you linking to the Site, etc. While all of this information can be associated with the IP address your computer had while you visited the Site, it will not be associated with you as an individual, or associated with any other information you may submit through the Site, or Company may store about you for any other purposes.

Company may use web site “cookies” in the process of compiling the statistical information mentioned above and to tailor certain pages of the Site for your browsing convenience. A cookie file can contain information such as the URL you came from, your computer’s IP address and domain type (e.g., .com or .org, etc.), your browser type, the country, state and telephone area code where your server is located, the pages of our site that were viewed during a visit, and any search terms that you entered on our site. This information generally is used for internal purposes, and we do not link your URL or IP address to any personal information unless you have logged into our Site with an established account login and password.  You have the option of setting your browser to reject cookies, but our Site may not function correctly if you do. Refer to the Help feature of your browser for information on disabling cookies. 

The Site is not directed to children. Company does not knowingly collect any personal information from children. If you are concerned about your child’s use of the Site, you may use web-filtering technology to supervise or limit access to the Site.

Use of Information. In general, we will use the information we collect about you only for the purpose it was collected, as otherwise provided in this Policy, and as permitted or required by law. For example, we might use your information to enhance our Site, or to communicate with you about the Site or our products and services.

More specifically, we collect and use your personal information for the following business or commercial purposes. We may change or add to the purposes we collect personal information. In that case, we will inform you and obtain your consent when required by law.

Surveys. When you participate in one of our voluntary surveys on the Site, we collect and may use that information to enhance our business functions, as well as other purposes such as analytics, marketing, and to help us serve you better.

Promotions & Sweepstakes. When you decide to enter one of our sweepstakes, contests and other promotional offerings through the Site which are completely voluntary, we may collect and use the information to run the sweepstakes, contests and other promotional offerings, as well as for other purposes, such as marketing activities.

Social Media and Other Online Platforms. When you decide to engage with us through one or more of our social media or other accounts, we may collect and use your user generated content, such as profile pictures or posts collected from social media or other online account participation. Should you choose to add a comment or review on our Site, the name and email address you enter with your comment will be saved to this Site’s database, along with your computer’s IP address and the time and date that you submitted the comment. This information is only used to identify you as a contributor to the comment section of the respective post and is not passed on to any of the third-party data processors detailed below. Only your name and email address that you supply will be shown on the public-facing website. Your comments and the associated personal data will remain on the Site until we see fit to either remove the comment or remove the blog post, subject to any applicable obligations we may have at law or in this Policy. You should avoid entering personally identifiable information to the actual comment field of any comments that you submit on the Site.

Forms and Email Newsletter Submissions. If you choose to subscribe to our email newsletter or submit a form on our Site, the email address that you submit to us will be forwarded to a third-party marketing platform service company. Your email address will remain within their database for as long as we continue to use the third-party marketing company’s services for the sole purpose of email marketing (or transferred to a new service provider should we decide to change platforms), subject to any applicable obligations we may have at law or in this Policy. You may unsubscribe using the unsubscribe links contained in any email newsletters that we send you or by requesting removal via email. When requesting removal via email, please send your email to us using the email account that is subscribed to the mailing list.

Other purposes. In addition to the specific purposes above, we may collect and use your personal information for the following purposes:

  • To provide you with information, products, or services you request from us.
  • To fulfill or meet the reason for which the information is provided, such as to confirm or process your order or payment.
  • To contact you and/or provide you with email alerts and other notices concerning our products, services, events, or news that may be of interest to you. For example, we may send you announcements, surveys, and newsletters using any communications preferences you have expressed. We may provide these communications via email, postal mail, online advertising, social media, telephone, text message (including SMS and MMS), push notifications, in-app messaging, and other means. Of course, if at any time you no longer wish to receive such communications, you have the option of unsubscribing from our mailing list for that communication.
  • To engage in marketing activities, such as direct marketing activities through email. You may stop such email communications at any time by contacting us as described in the email or by selecting “unsubscribe” in the e-mail marketing message.
  • To communicate with you in social media. If you connect your social media services or other accounts to our services, we may use this information to make your experiences with us more personal or share and use it as described elsewhere in this Policy.
  • To ensure your information is accurate and to personalize our communications to you. For example, we may aggregate your personal information with data from various sources for purposes of keeping information up to date.
  • To carry out our obligations and enforce our rights including those arising from any contracts made by or entered into with you including for billing, payment, and collections.
  • To review, improve, and monitor our website, applications, online services, and overall customer experience, including to provide customization to meet the specific needs.
  • To provide customer service and engage in quality control activities concerning our products and services.
  • For testing, research, analysis and product and service development. We may use data, including public feedback and surveys, to conduct research and for the development of the Site and the services, products, and information we provide.
  • To respond to law enforcement requests and as required by applicable law, court order, governmental regulations, or other lawful processes.
  • As described to you when collecting your personal information.
  • As necessary or appropriate to protect the rights, property, security, and safety of our guests, our employees, our consumers, our information systems, and the public. This may include health and related information such as in the case of an accident or injury that occurs on our property or to comply with health authorities and best practices.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.
  • To manage our recruiting efforts and employment and workforce relationships. These activities include, for example, sourcing and processing employment applications, onboarding employees and contingent workers, and carrying out a range of employments activities relating to the employment relationship, such as compensation, benefits, promotion, discipline, termination, and certain post termination activities.     

Disclosure of Information. In general, we will not disclose your information for any purposes other than those in conjunction with the business activities requested of us unless otherwise permitted or required by law or by this Policy. In the course of our normal business activities, we may disclose collected information to both affiliates and non-affiliated entities, as we deem necessary. For example, and without limitation, Company may need to use or disclose this information with its third-party vendors to manage its website, respond to subpoenas, defend litigation, enhance its services, and protect Company’s legal rights. We endeavor to choose affiliates and non-affiliates with similar standards to ours regarding the protection of personal information. 

In no case will Company sell or license personal information to third parties, except as required or permitted by law. For example, we may share personal information in connection with certain business transactions, such as the acquisition of all or substantially all of Company’s assets. In such cases, we will take appropriate steps under the circumstances and to the extent possible to ensure that the recipient agrees to provide privacy protections substantially similar to those established by this Policy.

Safeguarding of Information. No system for safeguarding personal or other information is 100% secure. However, we take a number of steps to reasonably safeguard the security of personal information obtained through the Site. Our data centers are maintained in a secure environment with appropriate security measures. Our employees are trained to understand the importance of confidentiality and are required to adhere to our privacy policies and procedures.

Applicable law. This Policy is governed by the internal substantive laws of Arizona, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within Arizona. If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy, which shall remain in full force and effect.
